Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Blue Banana EHR (“Blue Banana”, “Service”) at bluebananaehr.com, including the website, dashboard, FHIR API, agent endpoints, and webhook delivery system. Blue Banana is operated by Keragon, Inc.(“Keragon”, “we”, “us”).

By signing up, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Blue Banana is a mock electronic health record that exposes a FHIR R4 surface backed entirely by synthetic data generated by Synthea. It is intended for software development, integration testing, and demos.

Not for clinical use. Blue Banana is not a medical device, is not HIPAA-compliant, and must never be used to make clinical decisions, treat patients, store real Protected Health Information (PHI), or replace a real EHR. The data served by Blue Banana is fictitious.

You must be at least 13 years old (16 in the EEA and UK) and capable of forming a binding contract to use the Service. By creating an account you represent that you meet these requirements.

You are responsible for:

• The accuracy of the information you provide.
• Keeping your password and any API keys (bb_…) secret. Anyone with your key can act as you.
• All activity that occurs under your account.

If you sign in with Google, you also agree to Google's terms. We rely on Google solely to authenticate you and to provide the basic profile information described in our Privacy Policy.

You agree NOT to:

• Upload, transmit, or store any real PHI, personally identifiable health information, or any other regulated personal data through the Service.
• Use the Service to make actual clinical decisions or to provide medical advice, diagnosis, or treatment.
• Misrepresent the Service's output as real patient data, real lab results, or real clinical records to any third party.
• Attempt to reverse-engineer, decompile, or extract source code from the Service, except to the extent that applicable law expressly permits despite this limitation.
• Probe, scan, or test the vulnerability of the Service except through our coordinated disclosure process.
• Interfere with or disrupt the Service, including by sending traffic intended to overload it, bypassing rate limits, or evading bot-detection.
• Use the Service to send unsolicited messages, deliver malware, host phishing pages, or conduct any unlawful activity.
• Configure webhook destinations that target private networks, link-local addresses, or other systems you do not control.
• Resell, sublicense, or commercialize the Service or any of its output without our prior written consent.

Each account can mint personal API keys for programmatic access on /account. Keys are scoped to your tenant. We may apply rate limits, write quotas, and other usage limits and may change them at any time to keep the Service stable. We may revoke any API key that we reasonably believe is being abused.

The synthetic FHIR resources served by Blue Banana are derived from open-source Synthea output and are provided to you as-is for use with the Service. You may use, copy, and integrate against this data for testing, development, and demonstration purposes.

All software, designs, logos, trademarks, and content of the Service (excluding the synthetic data above) are owned by Keragon or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you. “Blue Banana”, “Blue Banana EHR”, and “Keragon” are trademarks of Keragon, Inc.

If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, worldwide, royalty-free license to use that feedback for any purpose, with no obligation to you.

You can stop using the Service at any time and request deletion of your account by emailing legal@keragon.com.

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, if your activity threatens the integrity or security of the Service, or if we are required to do so by law. On termination, any provisions that by their nature should survive (e.g. ownership, disclaimers, limitation of liability, governing law) will survive.

Blue Banana is a sandbox and is provided on a best-effort basis. We may modify, suspend, or discontinue any part of the Service at any time, including endpoints, response shapes, and rate limits. We will try to give reasonable notice of breaking changes but cannot guarantee it.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. KERAGON DOES NOT WARRANT THAT THE SYNTHETIC DATA IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, AND EXPLICITLY DOES NOT WARRANT THAT THE SERVICE IS APPROPRIATE FOR ANY CLINICAL, DIAGNOSTIC, OR MEDICAL USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KERAGON AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) IN THE AGGREGATE.

You will indemnify and hold harmless Keragon and its affiliates from any third-party claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party — including any claim that you uploaded, transmitted, or stored real PHI through the Service.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify signed-in users by email. Your continued use of the Service after an update means you accept the revised Terms.
